In consideration of the sum of £1 (which by signing this Agreement you agree has been fulfilled), by signing this Agreement you agree to the following:
- You agree to become an ID Checker for the LTA.
- You confirm that you will have access to an electronic device (e.g. iPad/tablet, computer or laptop) with an internet connection when meeting with applicants, either at your venue/organisation or that you have a personal device you can use at your venue/organisation.
- The matters contemplated by this Agreement and you confirm that you will treat the information that you receive when you are acting as an ID Checker as confidential and will not disclose them to any person (except with the prior written consent of the LTA, or as required by law). You will be provided with log in details in order to access the online system and you confirm that you will not share these details with any person.
- You will inform the LTA if you are no longer able or no longer wish to be an ID Checker.
- You agree to the following basic contact information being available on the LTA Website for people to contact you to arrange verification as part of their DBS check:
- Your name
- The name of your venue/organisation
- Your contact number and email (you must notify us in writing if you have a preference on which of these contact details is displayed, otherwise both sets of contact details will be used)
- You agree to verify DBS applications in line with the DBS Identity Checking Guidance.
- You agree to receiving and reading the DBS communications issued by the LTA with relevant legislation and ID checking information.
- As an ID Checker, in order to carry out ID checks for and on behalf of the LTA you will have access to personal data of which the LTA is a data controller, including each applicant’s: full name; gender; date of birth; nationality; address history; contact details; position applied for; level of DBS check; and identity documents such as bank statements, passports and driving licences (the Personal Data). By signing this agreement you agree to the following:
You will keep the Personal Data confidential and, except with the prior written consent of the LTA, will not:
(a) disclose or make available the Personal Data in whole or in part to any third party, except as expressly permitted by this agreement; nor
(b) copy, reduce to writing or otherwise record the Personal Data except as strictly necessary in order to carry out ID checks for and on behalf of the LTA; nor
(c) use, reproduce, transform or store the Personal Data in an externally accessible computer or electronic information retrieval system or transmit it in any form or by any means whatsoever outside of its usual place of business; nor
(d) transfer to or make available the Personal Data in any country outside the European Economic Area; nor
(e) communicate with any data subject (as defined by the Data Protection Act 2018) of the Personal Data, nor collect personal data from any individual except where specifically required to do so by the LTA (and in any event only in the manner specified by the LTA).
You will:
(a) use the Personal Data only to the extent, and in such a manner, as is necessary in order to carry out ID checks for and on behalf of the LTA, and in accordance with the LTA’s instructions from time to time, and not use or exploit the Personal Data for any other purpose;
(b) keep and provide to the LTA on request a record of your use of the Personal Data;
(c) take appropriate technical and organisational security measures to protect the Personal Data from loss, destruction, damage, unauthorised or unlawful use, copying and disclosure, and:
(i) observe and comply with any policy of the LTA relating to data protection or data security or which is otherwise applicable;
(ii) take any specific security measure the LTA may from time to time reasonably require by written notice you, in relation to the Personal Data;
(iii) promptly inform the LTA if any Personal Data is lost or destroyed or becomes damaged, corrupted or unusable and shall take such steps as the LTA may reasonably require to restore the Personal Data to its original condition;
(iv) promptly inform the LTA of any unauthorised disclosure of, or access to, Personal Data, and shall take such steps as the LTA may reasonably require to document and/ or report the incident; and
(v) allow the LTA, on reasonable notice and at reasonable times, to inspect or appoint representatives to inspect all facilities, equipment, documents and electronic data relating to the processing of any Personal Data;
(d) promptly inform the LTA if you receive any request, complaint, notice or communication which relates directly or indirectly to the processing of any Personal Data, and provide all reasonable assistance to the LTA in relation to any such request, complaint, notice or communication; and
(e) comply at all times with all applicable data protection legislation, laws, enactments, regulations, orders, standards and similar instruments, each as may be amended or re-enacted from time to time, including the Data Protection Act 2018, the General Data Protection Relation 2016/679, the Privacy and Electronic Communication (EC Directive) Regulations 2003 (the Data Protection Legislation), and not do nor omit to do anything in relation to Personal Data which could put the LTA in breach of the Data Protection Legislation.
