RENTAL AGREEMENT 

This Rental Agreement (this "Agreement") is being proposed on

by and between Paul House, ("Reservation Manager," Bozeman Cottage Inc Vacation Rentals, Inc.), and ("Guest"):
The Agreement will become effective upon Guest's payment of the Reservation Deposit (see below), and expires 10 days from the above date if not received by Reservation Manager. The parties agree as follows:

PREMISES. Reservation Manager, in consideration of the rental payments provided in this Agreement, rents to Guest a 2 bedroom, 1 bath house known as the Bohart Guest House (the "Premises") located at 510 N. Church, Bozeman, MT, 59715.

TERM. The Agreement term will begin on

RENTAL AGREEMENT PAYMENTS. Guest shall pay to Reservation Manager (Total Price:*)$
for the entire Agreement term, including the State of Montana bed tax of 7% (prices listed already include that tax).  Payments shall be made to Bozeman Cottage Inc, PO Box 562, Bozeman, MT, 59771. See Terms of Payments near the bottom of this page for information on reservation deposit, damage deposit, payment dates and cancellation policy.   Enter number of people you anticipate staying at the House

 (this number is usually an estimate - price can be easily adjusted once you arrive).  Extra people beyond the standard 4 will be charged $70/person/week.

KEYS.  A keyless entry lock on the front door will be programmed shortly before your arrival. Your passcode will be provided upon payment along with directions to the house. 

LONG DISTANCE PHONE USE. The phone at the house is available for unlimited local use and all toll free use. There is a long distance block on the line which unfortunately blocks credit card calls as well. If you need a calling card I would recommend the MCI or Sprint cards which do not have connection charges or hidden taxes.

SMOKING. There is absolutely no smoking allowed indoors on the Premises.

OCCUPANCY & RESTRICTIONS. Only the number of people specified above may occupy the Premises.  No guests or visitors may stay in RVs parked on the premises. Gatherings of more than 10 people in addition to the guests constitute an event that the Reservation Manager must be notified about to minimize neighborhood impacts; there may be an extra charge.  No bands may perform on Premises. No discharge of any firearm or hunting of any kind is allowed on Premises. Any illegal activity may result in immediate eviction and forfeiture of rent received. No commercial use of the house is allowed for any purpose.  Guest may not sublet the Premises. Guest agrees to abide by Reservation Manager’s House Rules found in “Guest Book.”  Guest will not make any alterations, remove anything, or do any repair without prior approval of Reservation Manager. Home Owner or Reservation Manager may enter at reasonable times for repairs or service. Home Owner or Reservation Manager is not responsible for any loss or damage to Guest's property. This wavier by Guest includes any loss, expense or damage, whether direct, indirect, consequential or otherwise.


ACCESS TO PREMISES BY OWNER OR MANAGER.  The Owner, Manager or agents thereof may access the Premises for reasons of urgent repair or maintenance of the Premises.

DANGEROUS MATERIALS. Guest shall not keep or have on the Premises any article or thing of a dangerous, inflammable, or explosive character that might substantially increase the danger of fire on the Premises.

PETS. No pets shall be allowed without the prior consent of the Reservation Manager.

 

CLEANING. The Premises shall be clean upon Guest's arrival. Agreement price includes three hours of cleaning which is sufficient for doing all bed linens and towels, vacuuming and light cleaning. Additional time spent cleaning may result in retention of part or all of the Damage Deposit.

DAMAGE. Guest will be responsible for any damage caused by Guest's use of the Premises. This includes any damage caused by anyone in Guest’s party or anyone on the premises at the Guest’s invitation or sufferance. Guest agrees that any damage may be charged to his/her credit card and submits to the jurisdiction of the appropriate Montana Court if litigation is necessary.

DEFAULT. Guest shall be in default of this Agreement if Guest fails to fulfill any Agreement obligation or term by which Guest is bound.

ENTIRE AGREEMENT/AMENDMENT. This Agreement contains the entire agreement of the parties. This Agreement may be modified or amended in writing, if the writing is signed by both parties.

GOVERNING LAW. This Agreement shall be construed in accordance with the laws of the State of Montana.  If any action in law or in equity shall be brought to recover any rent or charge under this Lease, or for or on account of any breach of, or to enforce or interpret any of the covenants, terms or conditions of this Lease, or for the recovery of the possession of the demised Premises, the prevailing party shall be entitled to recover from the other party as part of the prevailing party's cost, reasonable attorney's fees, investigation, affirming judgments or appeal, the amount of which shall be fixed by the court and shall be made a part of any judgment or decree hereof rendered.  The prevailing party will also be able to recover the cost of collection of those judgments.


TERMS OF PAYMENTS

RESERVATION DEPOSIT. The 25% reservation deposit shall be paid to Bozeman Cottage, Inc. at the time of the reservation and will be held by the Reservation Manager to be applied toward the remaining balance. For reservations made within 30 days of your arrival date, the total amount is due unless other arrangements have been made.

DAMAGE DEPOSIT.  Manager will use Guest's credit card for the purpose of securing a damage deposit.  Damage deposit will be used if necessary to repair damage or to perform extra cleaning.  The card will not be charged unless necessary. 

REMAINING BALANCE. 30 days before commencement of the rental, Reservation Manager will send you a reminder to pay the remainder of the Agreement payment, as well as accommodations tax. If you paid the reservation deposit by credit card, Reservation Manager will automatically charge the balance to the same card unless otherwise instructed.

CANCELLATIONS & CHANGES. Any cancellation made 60 days or more before the scheduled arrival date will receive a full refund of the reservation deposit, less a $75 cancellation fee. Any cancellation made within 60 days of the scheduled arrival date shall be subject to a forfeiture of the Agreement payments (including the remaining balance payment), unless the Reservation Manager is able to re-rent the Premises for the reserved dates at an equivalent rate.
    Once the reservation is finalized, changing houses, if possible, costs $25.  Changing dates costs $15. 

ACCOMMODATIONS TAX. The State of Montana collects a 7% bed tax on all home rentals less than one month in duration. The tax is applied to 75% of the rental amount and is included in the price of the rental (reservation administration fees of 25% of rental amount not taxable).

1.  Credit card payment with your card information.  Personal (not business) US-based Visa, Mastercard & Discover only*.  If you're comfortable emailing the information then type it in right here, otherwise I'll get the info over the phone.  I'll need your billing address if different from above along with the number and expiration date.

 

 

* For non-US payments there is a 1% surcharge for credit card transactions.  If you need to process a payment with a credit card from a country other than the US, then you will be charged the surcharge.  Other options are check in the mail or bank transfer. 

2. To pay by check or money order, wait for confirmation of receipt of your rental agreement, then mail check to Bozeman Cottage, Inc., PO Box 562, Bozeman, MT 59771.
